This Workmanship Warranty (“Warranty”) applies to services provided by Avello Group Pty Ltd (“Avello”) and is subject to the terms set out below. This Warranty covers Avello's workmanship only. It does not cover, and should not be read as extending to, the coating products applied as part of the works, which remain covered exclusively by the applicable paint manufacturer's material and/or performance warranty issued for this project. The benefits of this Warranty are in addition to any rights and remedies available under applicable law, including the Australian Consumer Law.
Warranty Coverage
Avello warrants that the coating system applied by Avello will not peel, flake or blister for a period of five (5) years from the date of practical completion, where such failure is a direct result of faulty surface preparation or application by Avello. This Warranty applies strictly to Avello's workmanship. It does not warrant the performance, durability or suitability of the coating products themselves, which are the subject of the applicable paint manufacturer's warranty referred to above.
Conditions of Warranty
This Warranty is conditional upon:
The coated surfaces being washed and maintained at least every twelve (12) months — or more frequently in coastal, industrial or high-pollution environments, or in accordance with the paint manufacturer's recommended maintenance schedule for this project, whichever is more frequent — to remove dirt, contaminants, mould, salt deposits and other pollutants.
The coated surfaces being used under normal environmental and service conditions.
The substrates to which the coating system was applied having been properly designed, constructed, and suitable for coating at the time the works were carried out.
Full payment of all contracted works being received.
Where the Customer has not met the maintenance requirement above, cover under this Warranty is affected only to the extent that the lack of maintenance caused or contributed to the specific defect the subject of the claim, and does not void this Warranty in its entirety.
Exclusions
This Warranty does not cover:
Timber surfaces;
Stained or clear-coated surfaces;
Existing, hidden or recurring corrosion, including corrosion originating beneath the coating system, and any recurrence of corrosion;
Access costs of any kind, including scaffolding, elevated work platforms, rope access, cranes, permits, shutdowns, traffic management or other access requirements;
Any areas not painted as part of the original contract;
Latent or pre-existing defects in the substrate;
Incompatible existing coatings or prior coating systems;
Contamination of the substrate or coating system from any source;
Previously completed work carried out by others, or otherwise outside Avello's control;
Efflorescence, moisture ingress, or hydrostatic pressure;
Colour fade, chalking, gloss reduction, or other effects of normal weathering;
Failure caused by movement, structural cracking, substrate failure, dampness or deterioration of the building elements;
Faulty building design or construction;
Damage caused by external factors including weather events, excessive heat, impact or misuse;
Coated surfaces that have been repaired, altered, pressure cleaned, or recoated by any person other than Avello following completion of the works; and
Any issue arising from causes outside the reasonable control of Avello Group.
Making a Claim
To make a claim under this Warranty, the Customer must provide written notice to Avello within fourteen (14) days of the defect first coming to the Customer's notice, and in any event within ninety (90) days of the defect first becoming apparent, including:
Project details and location;
Date of completion;
Description and photos of the issue.
Limitation of Liability
Avello's liability under this Warranty is limited, at its discretion, to one of the following:
Repair of the affected coating system;
Payment of the reasonable cost of labour to repair; or
Refund of the labour component of the original works.
Subject to the Australian Consumer Law, Avello's total liability under this Warranty, however arising, is capped at the original contract value of the affected works.
Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a remedy for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have services rectified if they fail to be provided with due care and skill.
General
This Warranty is non-transferable and applies only to the original Customer.
This Warranty applies to Avello's workmanship only and does not cover materials or products, which are covered exclusively by the applicable paint manufacturer's warranty for this project.
This Warranty supersedes all prior discussions or representations relating to workmanship warranty.
